Keeping all these aspects in view this Department has decided to issue consolidated instructions on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in supersession of all the existing instructions on the subject. The proposal is not to change any aspect of policy on the subject but only to consolidate all the instructions and present them in easy to understand form/language.
A draft OM has been prepared which covers all the aspects of reservation policy as existing at present. However, before issuing the proposed OM, it has been decided to put it in public domain and invite comments on it. If any person feels that the proposed OM does not include any of the existing instruction or any instruction included in the proposed OM is not in consonance with the existing instructions, may point out the same and send his comments to the undersigned by 12th July, 2010."

that there is lot of confusion amongst appointing authorities and others about the policy on
Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in services
under the Government of India. It has also been observed that though a number of instructions
issued by the Ministry of Home Affairs and this Department on the subject have become
outdated and are no more in operation, some Ministries/Departments etc. continue to follow such
non-existent instructions. It has, therefore, been decided to issue, in supersession of all Office
Memoranda on the subject issued so far, instructions on Reservation for the Scheduled Castes,
Scheduled Tribes and Other Backward Classes in Services as given in Appendix to this OM.

whenever any rules or instructions are reproduced or tried to re-write, there is every possibility of commiting serious mistakes and it is certainly going to dilute the original sense of rules. Your proposed instruction has no mention about the provisions contained in OM No.20011/1/2001-Estt.(D) dated 21-01-2002 regarding Seniority of SC/ST Government Servants on promotion by virtue of rule of reservation/ roster.This is one of eye opening example as how the welfare provisions which are made consequent upon the 85th constitutional amendment, are being diluted or deviated.

ReplyDeleteAs per my thinking no reservation given to any type of person i.e. SC/ST/OBC. When Govt. provide scholership to these type of persos for his better study. they why we again give him
reservation benifit to them. Thats why our Law maker( Indian Leader) not take his medical treatment from Govt. Hospitals and all, because they know very well that here only doctors comes from reservation catageory not as per his qualification and ability. So i suggest you that please give financial support to non creamy layer persons for his study after that no reservation in Service without any Age relaxation
