Child Care Leave - Clarification from PC of A(Fys) Kolkata

Subject:- Issue of Notification to amend the Central Civil Services (Leave) Rules, 1972.






Government of India, Ministry of Personnel, Public Grievances Notification issued vide their No: FNo:11012/1/2009-Estt.(L) dated 01.12.2009 regarding amendment to Central Civil Services (Leave) Rules,1972 has been uploaded on the website of HQrs. In the said rules, in rule 43-B, in sub-rule (1), for the figures and word “135 days”, the figures and word “180 days” shall be substituted:



In the said rules, after rule 43-B, the following rule shall be inserted, namely:-



43-C. Child Care Leave :- (1) A woman Government servant having minor children below the age of eighteen years and who has no earned leave at her credit, may be granted child care leave by an authority competent to grant leave, for a maximum period of two years, i.e.730 days during the entire service for taking care of up to two children whether for rearing or to look after any of their needs like examination, sickness, etc.



(2) During the period of child care leave, she shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.



(3) Child care leave may be combined with leave of any other kind.



(4) Notwithstanding the requirement of production of medical certificate contained in sub-rule (1) of rule 30 or sub-rule (1) of rule 31, leave of the kind due and admissible (including commuted leave not exceeding 60 days and leave not due) up to a maximum of one year, if applied for, be granted in continuation with child care leave granted under sub-rule (1).



(5) Child care leave may be availed of in more than one spell.



(6) Child care leave shall not be debited against the leave account.”

  1. Dear respected sir,
    When a women has two surviving children below 18 years needs mothers help. I am mentioning the following to clarify please through the govt orders.

    1. Women those who kept their children in baby sitting and not availed the E.L. for their children and now they have accumulated more than 200 E.L. How govt is making difference between those who do not have EL only can avail Child care leave but keeping inview that those who did not taken any kind leave and kept their children in Baby sitting and they have their credit EL, If women finished their EL then only can apply what is the use of Child care for this women. I want to suggest that EL accummulated to a women's credit more than 200 or 300 can also avail Child care leave without disturbing their EL account. Please suggest that so many womens have their credit EL can not avail this facility that means govt is openly doing injustice to those women having credit leave and cannot take Child care leave.

Let every women who have below aged children can avail Child Care Leave without disturbing their EL account then only the govt decision is fulfilled. otherwise some women having 50 or 100 earned leave they are started taking leave and afterwards they are availing Child care leave this is the parity between all womens those who peacefully do their duties and those who avail Child Care leave and enjoying but some women who are having 200 or 300 leave cannot avail this facility hence at workplace there misunderstanding and no peaceful work is going on. Please issue orders / circulars like all women those who have below 18 years children can avail Child Care leave without disturbing their EL Account.

  4. sir , i would like to know what about ladies serving in arm forces, A.M.C. Engineers, army nurcing services, are they also eligible for child care leave.

  5. what about women who have children above 18 years of age, who spent their el during their children sickness/ exams,put them in creche and suffered and are the worst hit people .Now the Govt has also been partial with senior women officials by not giving even 6-8 months at the rear end of their service , for their children weddings and connected issues. Hope the Govt grants some relief to senior women employees too.

    Is child care leave of 730 applicable of women having a single child. or is it 365 days for each child.

  7. What about the male employee who's wife died or divorced and children living with father, Are children won't need care Please clarify, if needed amend the order
