Salient Features of the National Council (JCM) meeting.

Highlights of the meeting :-




1. The 46th Meeting of the National Council (JCM) was held on 15th May 2010 under the Chairmanship of Shri K. M. Chandrasekhar, Cabinet Secretary.



2. More than 30 representatives of Staff Side and Official Side participated in the meeting.



3. The Chairman stated that although there has been a long gap between
the 45th and 46th meeting of the National Council.



4. The Chairman also stated that the meetings of the
Standing Committee have also been held quite frequently.



5. The Chairman then enumerated some of the decisions taken by the
Government in the recent past :



• The CCS (Revised Pay) Rules 2008 have been notified vide GSR
622 (E) dated 29th August 2008.



• Instructions have been issued vide O.M. No.1/1/2008-IC dated
30th August 2008 regarding fixation of pay and payment of arrears.



• Instructions regarding revision / refixation of pension/ family
pension have been issued vide O.M. NO. 38/37/08-P&PW dated 1st September 2008.



• Instructions regarding revision in the provisions regulating
pension/ gratuity/ commutation of pension/family
pension/disability pension/ex-gratia lump sum compensation
have been issued vide O.M. No.38/37/08-P&PW dated 2nd September 2008.



• Instructions / guidelines regarding the Modified Assured Career
Progression Scheme (MACP) have been issued vide O.M.
No.35034/3/2008-Estt (D) dated 19th May 2009.



• Instructions/ guidelines regarding enhancement in the quantum of
maternity leave and introduction of Child Care Leave (CCL) to
women employees have been issued vide O.M.
No.13018/2/2008-Estt. (L) Dated 11th September 2008.



• Instructions / guidelines regarding special casual leave to the
Central Government Employees with disabilities have been
issued vide O.M. No 25011/1/2008-Estt. (A) Dated 19th November 2008.



• In addition, most of the allowances of the Central Government
Employees have been doubled as per the recommendations of
the 6th Central Pay Commission.



6. The Leader, Staff Side Mr.M.Raghavaiah thanked the Chairman for apprising the
staff side of the important decisions taken by the Government.



7. Staff Side Leader requested the Official Side to take necessary action to review the CCL from the restrictions.



8. He also stated regarding Children Education Allowance that the original order granting CEA to maximum of eldest two surviving children.
This has resulted in problems and in certain cases the administration divisions of some Departments have even started recoveries.
He requested that once a decision is taken and implemented, it should be maintained and should
not be scuttled or diluted later in order to convey the right kind of message to the employees.



9. He stated that in reality an employee who hitherto got the two financial upgradations in 24 years under the old
ACP Scheme, shall now have to wait for three decades to get the same level of upgradations under the new MACP Scheme.



10. He referred to the mismatch in the pay drawn by a senior direct recruit inducted into the service prior to 1st
January 2006 and that of a junior direct recruit inducted into service after 1st January 2006 and stated that this is a genuine issue and requested the
official side to find out a way to rectify the anomaly.



11. He further stated that normally after every Pay Commission,
the Government used to raise the limit of the taxable income. This was
not done this time, with the result that even the low paid employees have
come within the ambit of the income tax.



12.Thereafter, Secretary, Staff Side Mr.Umraomal Purohit, while making his opening
thanked the Chairman and he pointed out that the
real problem lies at the level of the Departmental Councils where the
meetings have been held regularly in a very few Ministries / Departments.



13. Thereafter, Secretary, Staff Side referred to the 16 pending
awards of the Board of Arbitration and stated that these awards have not
been implemented by the Government and there is a need to discuss
them once again with the staff side. He further stated that it is the right time for a comprehensive review of the JCM
Scheme and suggested that a High Level Joint Committee may be
constituted for this purpose.



14. Secretary then appreciated the job done by the Fast
Track Committee (FTC) and stated that despite the clear cut
recommendation of the FTC regarding the Master Crafts Man, the same is
yet to be implemented by the Ministry of Defence.



15. Non-matriculate class IV employees who retired or died between
January 2006 and August 2008 without any re-training had also been
deprived of the benefit of pay fixation in PB-I.



The Chairman stated that the pending awards of
the Board of Arbitration would be reviewed. Regarding the suggestion to
constitute a high level committee to review the JCM Scheme, the Chairman
stated the matter may initially be discussed by the Secretary, DOP&T with
the Staff Side and then if needed, a committee could be constituted.



Secretary, Department of Pension and Pensioners’ Welfare assured the staff side that the matter will be reviewed in
consultation with the Central Pension Accounts Office, Controller General of
Accounts and Controller General of Defence Accounts and a deadline will be
fixed for issuance of the revised PPOs.



Agenda items :-



1. SUBJECT: REIMBURSEMENT OF AYAA CHARGES – DELEGATION THEREOF



The official side stated that the Ministry of Health and Family welfare, vide
its Office Memorandum dated 30th June 2008, has already addressed this problem. - ITEM FINALISED



2. SUBJECT: REIMBURSEMENT OF EXPENDITURE TOWARDS IMPLANTATION OF SPECIAL TYPES OF STENTS LIKE
CYPHER STENT ETC. IN CASE OF CS (MA) BENEFICIARIES – DELEGATION THEREOF



The official side stated that Ministry of Health & Family Welfare has already issued an Office Memorandum on 12th
September 2007 and a clarification in this regard has been issued on 8th
February 2010 and the request of the staff side has been addressed. - ITEM FINALISED



3. SUBJECT: PATHOLOGICAL & DIAGNOSTIC PROCEDURES



The official side stated that in the tenders issued in the current year, most
of the pathological and diagnostic procedures have been included in the
approved list. Further, across the cities where CGHS facility is available, many
private pathological & diagnostic labs are being empanelled which will address
the problems being faced by CGHS beneficiaries. Final orders in this regard are
expected to be issued by June 2010. - ITEM FINALISED



4. SUBJECT: GRANT OF FMA IN LIEU OF OUT DOOR TREATMENT FACILITIES



The official side stated that the concept of FMA will have greater chances of success once the health insurance scheme is
implemented. The guidelines of the proposed Health Insurance Scheme Central Government Employees and Pensioners have been shared with the staff side
where OPD is taken care of through FMA and for indoor treatment an insurance cover of Rs. Five lakhs is available to the beneficiaries.



The matter will be further examined by the Ministry of Health and Family Welfare in consultation with the Ministry of Finance.



5. SUBJECT: RELOCATION OF ONE CGHS DISPENSARY IN WADI AREA,
UNDER THE JURISDICTION OF MUNICIPAL CORPORATION, NAGPUR



The official side stated that the matter had already been discussed with
the staff side and it was agreed to have a joint inspection of Wadi area and
further action in the matter will be taken on the basis of the joint inspection report. - ITEM FINALISED



6. SUBJECT: SPECIALIZED CONSULTATION IN PUC HOSPITAL LIKE ISPAT HOSPITAL, HEC HOSPITAL & CCL HOSPITAL, RANCHI



The official side stated that the matter has been considered and it has
been decided to agree with the request of the staff side. - ITEM FINALISED



7. SUBJECT: SUPPLY OF FREE DIET TO EMPLOYEES AND THEIR DEPENDANT UNDER TREATMENT FOR TB, LEPROSY, MENTAL ILLNESS,
CANCER AND HIV/AIDS, RENAL DIALYSIS THERAPY, THALSAEMA.



The official side stated that the demand of the staff side has been
examined and suitable instructions have been issued by the Ministry of Health
and Family welfare, vide its Office Memorandum dated 22nd March 2010. - ITEM FINALISED



8. SUBJECT: SANCTION OF INCENTIVE ALLOWANCE TO CENTRAL GOVERNMENT EMPLOYEES WORKING IN EXTREMISTS
INFESTED AREAS



After a prolonged discussion, it was decided that the official side will re-
examine the matter.



9. SUBJECT: DECLARATION OF GANDHINAGAR AS LINK – CITY OF AHMEDABAD.



In view of the prolonged demand of the Staff Side, the
Chairman agreed to re-examine the matter.



10. SUBJECT: UPGRADATION OF JAMNAGAR AS B-2 TOWN WITH EFFECT
FROM 20.07.2006.



The Chairman stated that there was merit in the arguments put forward by the staff
side and directed the Department of Expenditure to re-examine the matter.



11. SUBJECT: A-1 STATUS TO BANGALORE CITY



The official side agreed to re-examine the matter.



12. SUBJECT: ANOMALY IN THE FIXATION OF REVISED PENSION
There was no change in the basic principle that special pay or
allowance shall not be reckoned for fixation of pension. Therefore, it is not
possible to agree to the demand of the Staff Side. - ITEM FINALISED



13. SUBJECT: ELIGIBILITY OF FAMILY PENSION TO WIDOW/DIVORCE
DAUGHTER/UN-MARRIED DAUGHTER WHO ARE NOW
ELIGIBLE FOR PAYMENT OF FAMILY PENSION FOR
INCLUSION OF NAMES IN PPOs ISSUED MUCH EARLIER.



The Chairman directed Secretary, Department of Pension & Pensioners’
Welfare to hold discussion with the Staff Side and issue clarifications wherever
required. - ITEM FINALISED



14. SUBJECT: GRANT OF FAMILY PENSION IN CASE OF MISSING
PENSIONERS AFTER TWO MONTHS




The official side stated that the time period of 2 months proposed by the
staff side is too short and agreed that the existing period of one year will be
revised to six months for payment of family pension. - ITEM FINALISED



15. SUBJECT: GRANT OF HALF DAY CASUAL LEAVE FACILITY FOR
INDUSTRIAL EMPLOYEES




The Chairman agreed with this and stated that suitable instructions would
be issued soon. - ITEM FINALISED



16. SUBJECT: RELAXATION OF UPPER AGE LIMIT FOR DEPARTMENTAL
CANDIDATES FOR APPOINTMENT TO GROUP C POSTS



The Chairman agreed to examine the suggestion of the Staff Side.



17. SUBJECT: RATE OF STITCHING CHARGE OF LIVERIES REQUIRES TO BE INCREASED



The official side agreed with the suggestion of the staff side. - ITEM FINALISED




18. SUBJECT: CASUAL LABOURERS (GRANT OF TEMPORARY STATUS & REGULARIZATION) SCHEME – NON IMPLEMENTATION OF.



The Chairman intervened and stated that if the Staff Side
had any legal point on this aspect, then the same may be forwarded to the
Department of Personnel & Training for examination.




19. SUBJECT: RESTRICTED HOLIDAYS FOR THE EMPLOYEES
WORKING IN THE INDUSTRIAL ESTABLISHMENTS



The Official Side agreed to re-consider the matter relating to grant of two days restricted holidays
to employees of industrial establishments.




20 SUBJECT: APPLICABILITY OF CCS (RSA) RULES 1993 TO THE
WORKERS EMPLOYED IN DEFENCE ESTABLISHMENTS



The Chairman decided that the matter will
have to be examined by the Ministry of Defence, in consultation with the Ministry
of Law and Department of Personnel & Training.

DATE OF NEXT INCREMENT IN EXTRA ORDINARY LEAVE CASES

One of the major demand from Staff side JCM in National Council, now the demand has been granted by the Government and published as order.

Subject: Regulation of the Date of Next Increment in case of Extra-Ordinary leave (without medical certificate) after implementation of the CCS(RP) Rules, 2008 – clarification regarding.

      Consequent upon the implementation of CCS(RP) Rules 2008, the increments in the revised pay structure are to be regulated in terms of Rule 10 of the CCS (RP) Rules 2008.This rule states that ‘there will be a uniform date of annual increment viz. 1^st of July every year. Employees completing 6 months and above in the revised pay structure as on 1^st July will be eligible to be granted the increment.”



2.       The issue of regulation of date of next increment in case of EOL (without medical certificate) after implementation of CCS(RP) Rules 2008, has been examined in consultation with the Department of Expenditure.



3.       It is clarified that except as provided under the conditions laid down in this Department’s OM dated 18.2.1986, qualifying service of less than six months on account of EOL (without medical certificate) between 1^st July of the previous year till 30^th June of the year under consideration shall have the effect of postponing the increment to 1^st July of the next year. The same stipulation will also be applicable to those cases where the increment became due on 1.7.2006. In terms of this Department’s O.M. No. 13017/20/85-Estt. (L) dated 18.2.1986, EOL granted for the following purposes automatically counts as qualifying service for pension and for increments without any further sanctions:-



      (i) EOL granted due to inability of a Government servant to join or rejoin duty on account of civil commotion.



      (ii) EOL granted to a Government servant for prosecuting higher technical and scientific studies.

Subject:        Demand of the Staff Side, National Council (JCM) for permission for OPD consultation for CGHS beneficiaries in hospitals run by public sector undertakings – Consideration of the




           The undersigned is directed to state that as per the procedure prescribed, CGHS beneficiaries are required to be referred b7y doctors in CGHS wellness centres (also known as dispensaries) for obtaining advice from a Government specialist before they are permitted to avail treatment / undertake tests, etc., in Government / private hospitals and diagnostic centres, as per their choice. Staff Side, National Council (JCM), had raised the following demand for discussion in the 46th Ordinary Meeting of National Council (JCM) held under the chairmanship of Cabinet Secretary on 15th May, 2010:




            “Of late all beneficiaries of Ranchi are being asked to take specialized consultation only in RIMS hospitals which is 12 km away from residences of pensioners from Doranda, Kadrn & Hindoo (Ranchi City). This is very inconvenient particularly for pensioner beneficiaries who have to travel this long distance and then to stand for long time in a queue. If they are referred to any of the public sector corporation hospitals (like Ispat, HEC & CCL HOSPITALS), which are nearby, they can get the consultation there in no time.”



2.            The demand of the Staff Side, National Council (JCM) has been examined in the Ministry of Health & Family Welfare, on consultation with IFD (Health) and it has been decided that CGHS beneficiaries in Ranchi can also be referred to hospitals run by public sector undertakings, in addition to the present practice of referrals to Government hospitals for consultation with specialists, subject to the following conditions:



      (i)     Reimbursement of charges for consultation undertaken in hospitals run by public sector undertakings will be as per rates fixed for CGHS, Ranchi, or actual consultation charge paid, whichever may be less; and


     (ii)      In so far as medicines to be supplied to the beneficiaries is concerned, CGHS will supply medicines of similar salt combination / potency from its’ own formulary / store, not necessarily the branded medicine that is prescribed by the specialists of the hospitals run by public sector undertakings.



3.      These instructions come into force from the date of issue of the Office Memorandum.


4.      This issues with the concurrence of IFD (Health), vide ID No.Dy.2115/10 dated the 14th May, 2010.

ALL INDIA ASSOCIATION OF NON-GAZETTED OFFICERS (AIANGO) Gen.Secretary dicussed with JS & FA (Defence) & in D(Fy-II) on 25th and 26th May, 2010

ALL INDIA ASSOCIATION OF NON-GAZETTED OFFICERS (AIANGO) General Secretary Mr.Chaubey has written a letter to Branch Secretaries, Zonal Secretaries, JCM Members, CE Members/Office Bearers, regarding dicussion with JS & FA (Defence) & in D(Fy-II) on 25th and 26th May, 2010. We reproduce the full text of the letter as given below...



President and General Secretary visited MOD on 25th to 26th May/10, specifically on the issue of Merger. Issue was discussed with JS & FA (Defence) & in D(Fy-II).



The position and instructions are appended below for information and immediate action please.




(1). PROMOTION: Despite of OFB's instruction to Fys, many Fys did not send the Clubbed Seniority List of CM-II+CM-I (T/NT) in time to OFB, as instructed vide Circular-18 our Branch Secretaries also could not

assured the same due to which DPC could not be held as per clubbed seniority. Promotions were ordered as per seniority list of CM-I. One more promotion list is likely to come for those streams which are yet not

cleared up to 2006. Further we have discussed and OFB has assured to hold Review DPC after issuing of Merged Seniority List at the earliest.




NOTE: ALL BRANCH SECRETARIES ARE SERIOUSLY REQUESTED TO ASSURE THAT SENIORITY LIST OF MERGED CM AS ASKED BY OFB (A/NG SECTION) IS SENT TO OFB BY THE FACTORY/UNIT WITHIN FEW DAYS

POSITIVELY SO THAT MERGED SENIORITY CAN BE ISSUED & REVIEW DPC CAN BE HELD AT THE EARLIEST.




(2). FUNCTIONAL UP-GRADATION AND MERGER OF AF/FM/SH WITH JWM: OFB has broken the commitment to issue merger order if the case of JWM comes back by this time in the meeting held on 30/03/2010

and 17/18-05/2010. NOW DGOF & Chairman is telling that He will merge the posts when the case of JWM is regretted and he has sent negative reply to MOD against the query of MOF. NOW the case is pending

with MOF-Expenditure for decision. We are putting our best efforts at the level of MOF-Expenditure for merger before any up-gradation of JWM . We have also taken up that in any case if Grade Pay Rs, 4800/- is

granted to JWM the same must be granted to AF/FM/SH/JTO under OFB/DGQA/DGAQA /DGNAI also. We are also exploring possibilities for the legal action.




(NOTE: As intimated earlier, we have very clearly placed our demand to Hon'ble RM, RRM, Defence Secretary, Secretary(DP), Hon'ble Finance Minister, Finance Minister for State, Secretary/Expenditure, JS(PER)

/Expenditure, Secretary/DOP&T and Hon'ble Prime Minister that AF/FM/ SH/JTO of all Directorates employing workshop staff i.e. Ordnance Factories, DGQA, DGAQA & DGNAI must be granted Grade Pay of Rs.

4800/- if JWMs of Ordnance Factories are granted the same. Officials of MOF have assured that there will be no change in cadre structure and only two Grade structure will be maintained in all the similar

Directorates like Railways, DGQA, DGAQA & DGNAI.)





(3). PROTEST PROGRAMMES:




(3.1). DHARANA WITH HUNGER : Representatives of AIANGOs will stage " DHARANA WITH HUNGER " on the date of coming JCM-III Meeting at Ordnance Factory Board, KOLKATA / at the place of JCM-III Meeting.

Note: OFB has yet not decided the date of JCM-III meeting. Date of Dharana will be the date of Meeting.




(3.2). MEMORANDUM TO HON'BLE RRM & RM in-mass AT NEW DELHI: Request letters have been submitted on 28th May, 2010 for confirmation of dates for submission of Memorandum by the representatives of

AIANGOs in mass at the residence of Hon'ble RRM & RM. Proposed date i.e. between 10-15 May was not confirmed. Confirmation of a fresh date is awaited from their end.






(4.) The Branch Secretaries who have not remitted the Subscription for year- 2009-10 are requested to remit the same at the earliest for smooth functioning of the Association.




(5). The Branch Secretaries who have not remitted the Special-Levy are requested to remit the same at the earliest for smooth functioning of the Association.




(6). CONTINUATION OF MEMBERSHIP OF THOSE AF OF DGQA/DGAQA WHO HAVE BEEN MERGED WITH JTO: SUCH JTOS WILL BE TREATED AS OUR MEMBERS AND THEIR SUBSCRIPTION SHALL BE DEDUCTED IN OUR

FAVOUR. A LETTER No: AIANGO/CE/SAF/DGQA/10 DTD. : 24/06/2010 HAS BEEN SENT TO DGQA HQ. IN THIS REGARD.




(7) DEDUCTION OF SUBSCRIPTION FOR THE YEAR 2010-11 FROM THE SALARY OF JULY 2010: ALL BRANCH SECRETARIES ARE REQUESTED TO ENSURE THAT LETTER FOR DEDUCTION IS GIVEN TO GM/DDO OF FY.

LATEST BY 4TH JULY /2010 AND THE DEDUCTION IS DONE WITHOUT FAIL FROM THE SALARY FOR THE MONTH OF JULY 2010.

National Council of JCM for Central Government Employees Meets
Government for Consensus Building With Employees: Cabinet Secretary



National Council(JCM), the apex body of the Joint Consultative Machinery for the Central Government Employees, met under the Chairmanship of the Cabinet Secretary Shri K.M. Chandrasekhar today. Senior Leaders of the Central Government Employees’ Unions/Federations and Secretaries of various Ministries/Departments actively participated in the deliberations.



In his opening remarks, Cabinet Secretary referred to the discussions held during the meetings of the Standing Committee of the National Council and the meetings of the National Anomaly Committee and reiterated the endeavour of the Government to maintain a sustained level of contact with the staff side to take forward the process of consensus building. He also enumerated some important decisions, taken in the recent past to increase the welfare, morale and productivity of the employees.



Cabinet Secretary also emphasized the need for the Staff Organizations to work in harmony with the official side to enhance productivity and efficiency.



Various issues of importance to the Central Government Employees and their families were discussed with a view to find amicable solutions and to ensure a harmonious relationship.

Subject: Request for free diet to CGHS beneficiaries undergoing treatment for TB, Leprosy, Mental Illness, Cancer, etc.

  

              
The undersigned is directed to invite reference to this Ministry's Office Memorandum, of even number dated the 20th May, 2009, vide which the rates for
subscription by CGHS beneficiaries to avail CGHS facilities were revised. The monetary ceiling for free diet was also revised. The following provisions had been made in respect of entitlement of free diet:in para 3 (C) and (d) of the Office Memorandum under reference:

  

"(C) Monetray Ceiling for Free Diet:The monetray ceiling for free diet for CGHS beneficiaries is revised to pay / pension / family pension of Rs. 7.450/- per month.

  

(D) Monetray ceiling for free diet for beneficiaries suffering from TB or mental disease):

  

The monetary ceiling for free diet in case of beneficiary suffering from TB or Mental disease is revised to pay / pension / family pension of Rs.11,160/- per month."

Staff Side, National Council (JCM) had proposed a demand for discussion in the meeting of the National Council that free diet to employees and their dependents undergoing treatment for TB, Leprosy, Mental Illness, Cancer & HIV / AIDS, Renal Dialysis therapy and thalassemia be also provided.



3.           
The demand of the Staff Side, National Council (JCM) has been examined in the Ministry of Health & Family Welfare in consultation with IFD (Health), and it has been dicided to extend free diet provision for CGHS beneficiaries undergoing treatment for TB, Leprosy, Mental Illness, Cancer & HIV/AIDS, Renal Dialysis therapy and Thalassemia when they undergo treatment in Central Government Hospitals, subject to the condition that the free diet will be restricted to beneficiaries who are drawing their pay in Pay Band 1 or retired from a post which now carries pay in Pay Band 1 and further subject to monetary limit of Rs.11,160/- per month.

The 9th steering committee of 11th Term JCM III Level Council, OFB hled on 12-03-201at OFB HQRS, Kolkata under the chairman ship of DDG/Admin. During the meeting the following points were discussed and the decision/position/progress to given below.




1. Payment of Night Duty Allowance arrears on the Notional Basic of IVth CPC + DA + Increment + Promotion between 1.1.1996 till date:


  Clarification of NDA which is now being paid on IV CPC pay scales from 1.1.96 was demanded to calculate by adding the increased DA + Earned Increments,

Promotion / ACP etc., till date. This was agreed by OFB, Revised package by PC of A factories was issued. Few factories have paid the arrears and calculating on the

revised package. It was insisted that many factories have not paid. It should be ensured that all the ordnance factories should make the arrears payment and the details

should be given in the next meeting.




2.OT Payment on revised VI CPC Pay:



  It was demanded that the OT allowances should be paid on the VI CPC scale without further delay. It was informed to OFB that Railway Board issued orders

recently to pay OT allowance on the revised pay w.e.f. 1.9.2008 by calculating HRA, TA, DA and Ration Allowance. Similarly it was demanded to calculating OT pay to

ordnance factory employees without further delay on the revised pay.




3.Co-Relation of piece work profit on revised pay:


  It was demanded that there should not be any further delay to Co-Relate the piece work profit in the minimum of the pay band with Grade Pay.



4.Payment of piece work profit to those employees who were promoted / Granted ACP on the upgraded Pay / Grade Pay:


 
 Though the Co-relation is delayed, but the employees who were promoted / granted ACP after 1.9.2008 have not paid piece work profit on their pay. It was

agreed to consider and was referred to PC of A fys.

Demanded the following:




a) MACP benefit to Teaching staff of Ordnance factories.


b) Merger of AF / FM / SH with JWM or to promote ch/man to AF immediately.


c) Holding of DPC for PR Teachers for their promotion.


d) Continuing of Risk Allowance and Patient Care Allowance.


e) Granting of EL 30 days to Direct Workers without delay.


f) Granting of incentive to Labourer SSK working in maintenance sections.


g) Early clearance of SLP to allow Direct Recruitment in HVF, OFT, OFP madek and EFA.


h) Special increments granted to stenographers through Arbitration Award should be treated as Part of Pay.


i) Granting of Departmental OT 3 ¼ Hrs. for Piece Workers to be considered. PC of A fys agreed to consider.


j) Early sanction of Manpower to Ordnance Factories during the year 2010-11 for Direct Recruitment against wastage vacancies arised during the previous year.


k) Cadre review proposal by OFB for para medical staff should be forwarded to Mof D by OFB without further delay.


l) Pharmacists awarded Rs.4200 Grade Pay should be granted w.e.f. 1.1.2006 and the clarification deleting of 2 years should be made clear.


m) Cadre review proposal for all categories should be prepared and forwarded to consultation with staff side and accordingly Recruitment Rules should be

amended.


n) The residency period prescribed by DOP&T should not the followed wile filling the vacancies fallen prior to 1.9.2008 and as per Recruitment Rules only should be

followed.


o) Removal of stagnation for store Keeping staff (SK & Supervisor) after the merger of Ch/man II & I , the vacancies fallen will be filled by promotion.


p) Agreed to declare the advertisement for filling the Ch/man vacancies through LDCE by April.




Further OFB agreed to consider the following.


Ø NIES who have got Rs.1900 Grade Pay, if willing to become labour SSK (GP Rs.1800) Grade Pay will be considered since their pay will e protected as per recent

Government orders.



Ø Laborer USK now become Laborurer SSK their up gradation will be ignored for MACP. Their promotion to SK also will not be counted for MACP orders were

issued.



Ø Agreed to grant Compassionate Appointments to those who were offered appointment prior to VI CPC orders even if they are less than matriculate but will be placed

in S1 - Scale (OFB issued order instruction No.63/2009(PCC) dt 29.12.2009.



Ø Recovery of subscription to wards GPF for new pension scheme employees under scheme – II was discussed but were informed that the matter may be discussed at

national council (JCM).





OFB asked the federations, to submit their cadre review proposal to within seven days, so that OFB can in corporate in their proposal and consult with the

federations. You many forward proposals for the following cadres.


Ø Industrial Employees


Ø Store Keeping Staff


Ø Supervisor Staff (Ch/man to JWM)


Ø Fire Fighting Staff


Ø Cart while group ‘D’


Ø Stenographers Cadre


Ø Hindi/Raj basha Cadre.




Regarding the four grade structure of Artisan (Trades Man) and upgardation of MCM Grade Pay to Rs.4200 and HS-I Grade Pay to Rs.2800 was referred to DoP&T and

the same was approved by DoP&T and sent to Mof Defence on 26.2.2010. Now the file was sent to Defecnce (Finance) for their approval. Now pending there. Any

moment, it can be cleared. We have asked one time relaxation for Highly Skilled from Trade Test and to give effect from 1.1.2006. Due to this, MACPS also pending in

many factories. MCM will be feeder grade to Ch/man infuture.

The undersigned is directed to saythat consequent upon the revision of daily allowance by the Department of Expenditure vide O.M. No. 19030/3/2008-E.IV dated 23rd September, 2008, the JCM members shall be entitled to Daily Allowance in the following manner w.e.f. 1st September, 2008.

A. (i) National Council / Departmental Council (JCM)
Reimbursement for Hotel accommodation of up to Rs. 3000 per day; reimbursement o non-AC taxi charges of up to 50kms.per diem for travel within the city and reimbursement of food bills not exceeding Rs. 300 per day.

(ii) Regional / Office Council
Reimbursement for Hotel accommodation of up to Rs. 1500 per day; reimbursement of non-AC taxi charges of up to 50 kms.per diem for travel the city and reimbursement of food bills not exceeding Rs. 200 per day.

JOINT CONSULTATIVE MACHINERY



JOINT CONSULTATIVE MACHINERY IN ORDNANCE FACTORIES JCM – I , JCM – II , JCM – III , JCM – IV



In 1967 Govt. of India introduced the ‘Scheme for Joint Consultative Machinery and Compulsory Arbitration’ for Central Govt. employees. The objective was to promote armonious relation, securing greatest measure of cooperation between Govt. in its capacity as employer and the general body of its employees in matters of common concern and increasing the efficiency of the public service.



The Scheme provides for setting up of Joint Councils at three levels viz.


(i) National Council (JCM-I) functioningat Cabinet Secretariat



(ii) Departmental Council (JCM-II) functioning at the concerned administrative Ministry and



(iii) regional / office council (JCM-III) functioning at the lowest level of the administrative set-up.
For Ministry of Defence Establishments, however, a four tier arrangement was agreed to and accordingly in the case of Ordnance Factories in addition to JCM-I (National) and JCM-II (Departmental), the following Joint Councils were set-up :- JCM – III : functioning at OFB HQrs.



JCM – IV : functioning in each of the factories under OF organisation.



The Scheme clearly demarcates the jurisdiction of the Joint Councils at each level, the items and the circumstances in which these will qualify for compulsory arbitration by a Board of Arbitration consisting of these members, one from Official side, one from Staff side and a Chairman who will be an independent person. Subject to the overriding authority of Parliament, recommendations of the Board of Arbitration will be binding on both sides.



The Scheme, Constitution of Third and Fourth Level Councils for Defence Civilians, Draft Rules for the conduct of business of these Councils, Declaration of Joint intent regarding the common approach of Govt. of India and the employees organizations to work the machinery of Joint Council and Compulsory Arbitration and forms for nominations of Staff Side Members of the Departmental Council were forwarded to DGOF, amongst others, under Ministry of Defence letter No. 7(2)/66/D(Lab) dtd. 24-7-1967.



The factories had been furnished with copies of these documents under DGOF Circular No. 652/A/W dated 3rd November 1967 and asked to forward copies thereof to the recognised Trade Union(s), recognised Associations and Works Committees functioning in the respective factories. JCM-III at DGOF HQrs. and JCM-IV at the factories have been formed in accordance with the provisions laid down in the scheme and the constitution for these Councils. The special meeting(s) of the convened to transact the following business:-


(i) Signing of Declaration of Joint Intent.


(ii) Adoption of Draft Rules for Conduct of Business.

The Staff Side have, however, highlighted that periodic meetings of JCM are not being held and that Departmental Councils have also not been re-constituted in some of the Ministries/Departments.
