while in service, Death Gratuity is granted at the
following rates depending upon the length of
qualifying service put in by the deceased employees: -

Defence Industrial Employees are expected grant of pay scale Rs. 5000 – 8000 to Master Craftsman( MCM) at par with the Railways…





Brief facts of case for parity in pay scale of Master Craftsman (MCM)
in MOD at par with Ministry of Railways.<
br>


Vth CPC recommended the pay scale of Rs.4500-125-7000 to Master Craftsman, both in Railways and Defence and was implemented.

However, the scale of MCM in Railways was revised upwards to Rs. 5000-8000 in modification of 5th recommendations with the approval of Cabinet. Prior to implementations, the Defence Artisan staff and Railway workshop staff had a common three grade structure comprising of Skilled, Highly skilled II and Highly skilled I.

In the Ministry of Defence the benchmark ratio of Artisans was 65:20:15 respectively to Skilled, Highly skilled GrII and Highly skilled GrI.

In addition to the aforesaid three grades, 10% of the Highly skilled grade I strength was operated in the post of Master Craftsman in some of the trades.

The post of Master Craftsmen was personnel to the holder and lapses with his retirement / posting out. As can be seen, the post of MCM is a personal grade post carved out of HS I grade as an incentive to Senior Highly skilled workers.

5th CPC has reduced the then existing three grades of Artisan staff to two grades by merging Highly skilled Gr II (HS II) and Highly skilled Gr. I (HS I) into one grade of Highly skilled (HS) as shown below,

Staff side demand for revision of the recommendations of Vth CPC was discussed in the meeting held by the then Group of Ministers on 11th Sep, 1997 and it was agreed that to remove this anomaly the concerned administrative Ministries will put up proposals directly to the Cabinet under Business of Transaction Rules, 1961.
Accordingly, the Ministry of Railways directly put up the proposal to the Cabinet. Railways demand was accepted by the Government and pay scale of MCM was revised from 4500 – 7000 to Rs. 5000 – 8000 from 1.1.1996, vide Ministry of Railways (Railway Board) letter No. PC-V/97/R-II/17 dated 24-11-1998. The scale of pay of HS grade was de-merged into HS-I and HS-II with separte scales of Rs.4500 – 7000 and Rs,4000 – 6000 respectively.



Following two proposals were also put up by Defence Ministry to the Cabinet for consideration:-

a. Grant of higher pay scale for highly skilled artisan staff in Defence Establishment;

b. Revision (de-merger) of inter-grade ratio for skilled artisan staff working under Ministry of Defence nullifying the recommendations of the Vth CPC.

However in case of Defence Ministry, Cabinet decided that the matter may, in the first instance, be considered by the Group of Ministeres (GoM) constituted to consider matters relating to the recommendations of Vth CPC and thereafter brought up before the Cabinet.



“ The issue of higher pay scale to highly skilled artisan staff in Defence Establishments could be considered only if the Ministry is able to confirm that consequent to the proposed de-merger of the pay scale of highly skilled grade, no proposal seeking higher pay scales for PBORs will be raised.”

Following pay scales and grade ratio have benn given to them in MOD:-

The issue was however raised by the staff side members of JCM in Departmental Council as well as in National council meetings repeatedly. To resolve the issue, Defence Secretary had constituted a committee under the Chairmanship of JS(O/N) comprising staff side members from each Federations to look into the matter regarding revision of pay scale of MCM in Ministry of Defence at par with Ministry of Railways.
The committee recommended for up-gradation of pay scale of senior most master craftsman (8% of overall artisan strength) by giving higher pay scale of Rs.5000 – 8000 without disturbing the existing structure. The committee felt that the service personnel and civilian workshop staff are governed by different service conditions and their pay scales and working conditions are not comparable. The committee has come to the conclusion that the demand of the staff side has merit.
The historical parity was disturbed between the workshop staff of Defence or Railways after the scales of Railways workshop staff were improved upon by Government. Based on the recommendations of the committee, a proposal was submitted to Defence (Finance) for getting, it approved by DOP&T of Finance (Department of Expenditure).
Department of Expenditure, Min of Finance has returned the proposal advising the Min of Defence to put the matter before 6th CPC. The issue has again been raised in the 45th meeting of the National Council (JCM) held on 14th Oct 2006 under the Chairmanship of Cabinet Secretary. The Chairman has also directed that it would be appropriate to refer the matter for consideration to the 6th CPC.

This is in remembrance of the lives lost in the devastating fire that erupted and the explosions that followed on 14 th April, 1944 at the Victoria Dock in the Bombay Port and also to prevent fire in all industry, .


The National Safety Council (NSC), has been promo ting the FSW Campaign since 1999 with a view to propagating fire safety awareness. The Campaign provides a unique opportunity to enhance fire safety awareness and mobilize action amongst employees, their families and the public.

House Building Advance to Central Government Employees



An important order has been published from Ministry of Urban Development regarding House Building Advance to Central Government Employees.



1.House Building Advance is admissible to all those temporary employees also,
who have rendered 10 years of continuous service.




2.With effect from 27-11-2008.



3.The maximum limit for grant of HBA shall be 34 months' of pay in the pay band.




4.Subject to a maximum of Rs. 7.50 lakh or cost of the house or the repaying capacity whichever is the least, for new construction/purchase of new house/flat.



5.The maximum limit for grant of HBA for enlargement of existing house shall be 34 months' pay in the pay band.



6.Subject to a maximum of Rs. 1.80 lakh or cost of the enlargement or repaying capacity, whichever is the least.



7.The cost ceiling limit shall be 134 times the pay in the pay band.




8.Subject to a minimum of Rs.7.50 lakh and a maximum of Rs.30 lakh relaxable up to a maximum of 25% of the revised maximum cost ceiling of Rs.30 lakh.



9.The rate of interest on House Building Advance is between 5% to 9.5% ,depending on the loan amount.



10.The repaying capacity of Govt. servants who have more than 20 years of remaining service has been revised from 35% to 40% of pay.



CONDITIONS:



The applicant or spouse or minor child should not already own a house in the town/Urban agglomeration where the house is proposed to be constructed or acquired.



b) The title to the land should be clear. The land may be owned either:

- by the Government employee; or

- jointly by the Government employee and spouse.



COST CEILING:



134 times of pay in the pay band subject to a minimum of Rs. 7.50 lakh and a maximum of Rs.30 lakh (Cost of the house, excluding cost of land should not exceed 134 times of the Basic Pay excluding Grade Pay)



Administrative Ministry may relax the cost ceiling to 25% of cost ceiling mentioned above in the individual cases on merits.



Effective from 27th November, 2008.



Eligibility, Purposes and Conditions as follows...



If both husband and wife are Government Employees, Advacne is admissible to only one of them.



Acquiring a plot and constructing a house thereon.




Enlarging living accomodation in an existing house owned by the employee or jointly with spouse. The total cost of the existing structure (excluding cost of land) and the proposed additions should not exceed the prescribed cost ceiling.




Purchase of house / flat under "Self - Financing Housing Scheme and " Co-operative Group Housing Societies".




For purchase of houses / flat from private parities, i.e., registered builders, architects, house building societies, etc., but not from private individuals.




If GPF withdrawl is also taken for house building, the total amount of GPF withdrawl and the House Building Advance should not exceed the cost-ceiling limit.



House / Flat constructed / acquired with the help of HBA to be used for residential purpose only.



The advance will be limited to the estimated cost of consturction.



Only one advance is admissiable during the entire service.



The amount of advance shall be restricted to the repaying capacity of the employee.



The amount of advance sanctioned can be reduced at the request of the employee to avail of the reduced rate of interest, if the entire advance has not been drawn.




For purchase / Construction of flat or Purchase of a house the amount of advance sanctioned in one lumpsum.



The construction should be exactly according to the approved plan and specification.



The consturction should be completed whithin 18 months of the dateon which the first instalment is drawn.



On completion of construction/purchase, the house should be insured by the employee at his cost against fire, flood and lightning for the full value of the house.



No interest is chargeable beyond the date of reirement/ death of the government employee.



The rate of interest will be reduced half per cent for an employee who undergoes sterilization(family planing).



The entire amount of advacne together with interest is repayable in 20 years. 180 monthly instalments for principal and 60 instalments for interest.



Recovery will commence from the pay for the month following that in which advance is taken.

Government of India has introduced a new Scholarship scheme

DIRECTORATE OF GOVERNMENT EXAMINATIONS,

CHENNAI – 600 006.

The Ministry of Human Resource Development, Department of Higher Education, Government of India has introduced a new Scholarship scheme titled “Central Sector Scheme of Scholarship for College and University Students”, which will be implemented from the financial year 2008-09. A certain number of Scholarships under this scheme have been ear-marked for the students who have secured 80% and above in the Higher Secondary Examination, March 2008 conducted by this department and pursuing higher studies.

The scholarship will be given @ Rs.1000/- per month at Graduation level for first three years of College and University courses and Rs.2000/- per month at Post graduation level. Students pursuing professional courses would get Rs.2000/- per month in the 4th and 5th year. The scholarship would be paid for 10 months in an academic year.

The award of scholarship shall be subject to the following conditions:

1. The scholarship shall be awarded to the Indian nationals only.

2. The Undergraduate/Post graduate/Professional course are pursued in a recognized college/institution in India.

3. The student should have scored a minimum 80% of marks in the Higher Secondary Examinations, March 2008 conducted by the State Board of School Examinations, TamilNadu, Chennai – 6.

4. The students should belong to non-creamy layer as defined by the Department of Personnel and Training in their Notification No.36012/22/93-Estt. (SCT), dated 08.11.1993 and as modified vide their OM No.36033/3/2004-Estt.(Res) dated 09.03.2004 and as may be further modified from time to time and not availing of any other scholarship scheme.

5. The reservation would be applicable in terms of Central Reservation Policy and internal ear-marking.

6. The scholarship will be distributed amongst Pass outs of the Science, Commerce and Humanities Streams in the ratio of 3:2:1 with equal number among boys and girls. Depending on the number of scholarship allotted to this Board, candidates who have secured the cut - off marks (as per the table below) in the Higher Secondary Course Certificate Examination, March 2008 conducted by the State Board of School Examinations, Tamil Nadu are being provisionally considered for award of “Central Sector Scheme of Scholarship for College and University Students”.

Appointment of meritorious sportsmen - Rules

Subject:
Appointment of meritorious sportsmen to Group C and D posts in relaxation of the procedure.



General Scheme :-

Under this Department 's O.M. No. 14/1/72-Estt. (D) dated 28.12.72 orders were issued that the Secretary of the Ministry/Department or the Head of Department under it may recruit a meritorious sportsmen to a class III or class IV service/post (now Group C & D) in the Ministry/Department/Establishment, as the case may be, direct recruitment to which is made otherwise than through a competitive examination held by the Union Public Service Commission, subject to the provisions contained in that O.M. with the coming into being on the Staff Selection Commission, recruitment to group C posts have generally to be made through the Staff Selection Commission. The entire policy of recruitment of sportsmen in various Departments/Offices has since been examined and the following orders are issued for providing for relaxation of recruitment rules to the extent mentioned below:-



ELIGIBILITY :-

Appointments under these orders can be made of a sportsman considered meritorious with reference to the following criteria :-

Sportsmen who have represented a State or the country in the National or International competition in any of the games/sports mentioned in the list at Annexure (A).

(ii) Sportsmen who have represented their University in the Inter-University Tournaments conducted by the Inter-University Sports Board in any of the sports/games show in the list at Annexure 'A'

(iii) Sportsmen who have represented the State Schools Teams in the National Sports/Games for Schools conducted by the All India School Games Federation in any of the games/sports shown in the list of Annexure 'A'.

(iv) Sportsmen who have been awarded National Awards in Physical Efficiency under the National Physical Efficiency Drive.


No such appointments can be made unless, the candidate is, in all respects, eligible for appointment to the post applied for, and in particular in regard to age, educational or experience, qualification prescribed under the Recruitment Rules applicable to the post, except to the extent to which relaxations thereof have been permitted in respect of class, category of persons to which the applicant belongs.


Posts to which applicable

Appointment of meritorious sportsmen can be made to any post in Group C or Group D which under the Recruitment Ruler applicable thereto, is required or permitted to be filled by direct recruitment, otherwise than through the Union Public Service Commission.

No such appointment shall be made to any post in Group A or Group B by direct recruitment.
A meritorious sportsmen can be considered for appointment under sub para(a) above notwithstanding the fact that he is already in the service of the Government.

In making appointments to any post under the Government by promotion, no preference shall be given to meritorious sportsman though that fact may be taken into account in assessing the overall merit.



3. Extent of such recruitment

Ministries/Departments of Government of India can recruit meritorious sportsmen in any year in relaxation of the recruitment procedure, to the extent that these including all other reservations under existing orders do not exceed 50% of the total number of vacancies proposed to be filled by direct recruitment.

For the purpose of making appointment of meritorious sportsmen, the appointing authorities may at their discretion notify to the Staff Selection Commission, in all case where the recruitment to the posts have been entrusted to that Commission, vacancies reduced by upto 5% thereof and may fill such vacancies so held back by appointing meritorious sportsmen subject to the overall limitations mentioned in sub-para (a) above.



4. Seniority

Where sportsmen are recruited through the Employment Exchange or by direct advertisement and are considered along with other general category candidates, they may be assigned seniority in the order in which they are placed in the panel for selection.


Where recruitment to a post is through a selection made by the S.S.C., whether by a competitive examination or otherwise, the sportsmen recruited by the departments themselves should be placed enable junior to those who have already been recommended by the S.S.C. The Inter-se-seniority of sportsmen will be in the order of selection.



5. Procedure

An application received by the appointing authority or a higher authority from a sportsmen belonging to any of the categories mentioned above, may be considered by the Ministries/Department or the Head of the Department, as the case may be, in light of the evidence which the applicant may furnish of his having represented in any of the competitions mentioned in the previous paragraphs, and subject also to the applicant fulfilling the requisite qualifications relating to education, age etc. as may be laid down in the rules for the post/service for which he is a candidate. Normally certificates awarded by the authorities mentioned in Annexure ‘B’ should alone be taken into account while considering the eligibility of an applicant in terms of above paragraphs. Appointments may be made of such a candidate after the Ministries/Department or Head of the Department, as the case may be, is satisfied about the eligibility of the candidate under these orders as well as his suitability for the post in all respects. Where the appointing authority is subordinate to a Head of Department, such authority may make a recommendation in this regard to the Head of the Department, along with the necessary details, for obtaining his concurrence in the proposed appointment of the candidate.
The orders contained in these O.M. will not affect the orders relating to reservations for SC/ST and Ex-servicemen which may be inforce from time to time. In other words, the vacancies filled in accordance with these orders in a year shall be taken into account in calculating the total number of vacancies in the service/post during that year for purpose of applying the reservation orders.


6. These orders apply to all Ministries and Departments of Government of India including the Ministry of Railways and Communications (P&T) and any existing scheme if any of the Ministries/Departments shall, from the date of issue of these orders, be subject to the conditions and restrictions herein specified, except to the extent of such modifications as may be accepted by Government in view of special circumstances prevailing therein.


7. A consolidated annual statement showing the number of sportsmen of the eligible categories appointed to Group C and Group D posts/service in a calendar year may be sent to the Welfare Division of the Department of Personnel by each Ministry/Department in the proforma given in Annexure 'C' by the 31st March, of the following year.


8. Provisions contained in this O.M. supersade all instructions issued from time to time in the past, on the subject.

9 Major Central Trade Unions Led by Various Political Parties

History of Trade Unions:-
1918 P.P. Wadia founded the Madras labour Union.
By 1920 trade unions appeared in all states.
AITUC was set up under the Indian National Congress to coordinate the
efforts of trade unions in the country.
In 1926 the Trade Unions Act was passed.
In 1929 AITUC split and the right wing formed itself as
All India Trade Union Federation under N.M.Joshi and the left wing was
captured by the communists.
AITUC again split and a militant Red TUC was formed under Ranadive.
Another right wing union-National Federation of Labour-NFL- was
formed and this later merged with AITUF to form NTUF -
National Trade union Federation.
1935 RTUC merged with AITUC.
In 1938 The BOMBAY Industrial Disputes Act was enacted which
provided for compulsory recognition of unions, certification of standing
orders, establishment of industrial courts etc.
During Second World War AITUC and NTUF merged and became
the only major union.
AITUC which supported war efforts split and Indian Federation of
labour was formed.
During the war TU activities were barred under DIR rules.
In 1947 there was another split and INTUC was formed under
Congress leadership.
AITUC remained a left wing TU .In 1948 supporters of Praja Socialist
party formed
HMP- Hind Mazdoor Panchayat which later merged with IFL and formed
HMS-Hind Mazdoor Ssngh. 1970.
AITUC split and the left communists formed
CITU-Centre Of Trade Unions.In 1972 following emergency
INTUC, AITUC and HMS joined and made a common platform.
They formed a national apex body with employers’ organizations
during emergency.
After emergency they again split.Presently there are
9 major central trade unions led by various political parties.

  • Hind Mazdoor sangh(HMS) Socialist party.

  • UTUC R.S.P.

  • UTUC (Lenin Sarani) radicals.

  • National Front of Indian Trade Unions.

Besides there are 13 other central Trade unions in various national
institutions and occupations -railways, Banks, postal etc. they are not
affiliated to political parties or central bodies.
Politically affiliated trade unions play a role in influencing the govt. in
policy making on labour matters.

Medical Attendant Rules - Central Government Health Scheme


Central Government Health Scheme

(CGHS)

The medical facilities under the Central Government Health Scheme are available to all the employees paid from the civil estimates and their family members residing in the area covered by the scheme.
An employee can opt out of the scheme and avail of the medical facilities provided by the employer of his spouse. If an employee or a member of his family covered under the Scheme falls ill at a place not covered under CGHS, the treatment shall be admissible under CS(MA) Rules.

The medical facilities to the Central Government employees and their dependent family members are provided under the Central Government Health Scheme in the following cities:

Definition of Family :-
‘ Family’ means employee’s

(i) Husband/Wife including more than one wife and also judicially separated wife.

(ii) Parents and Stepmother. In the case of adoption, only the adoptive and not the real parents. If the adoptive father has more than one wife, the first wife only. A female employee has a choice to include either her parents or her parents-in-law; option exercised can be changed only once during service.

(iii) Children including legally adopted children, stepchildren and children taken as wards subject to the following conditions : Son -Till he starts earning, irrespective of age limit.
Daughter -Till she starts earning or gets married, whichever is earlier, irrespective of age-limit. Son suffering from Permanent disability of any kind (physical or mental) -No age -limit.

(iv) Widowed daughters and dependent divorced/separated daughters. (v) Sisters including widowed sisters.

(vi) Minor borthers and dependent brothers. But the above persons should reside with the government servants and their income from all sources should not be more than Rs.1500/- per month.

Contribution:-
A compulsory monthly contribution is charged from all the entitled classes of government servants on the basis of rates fixed by the government from time to time. The present rates of contribution are as under:

Husband and wife are Central Government servants:-

When both husband and wife are Central Government servants covered by the scheme, the contribution will be recovered from only one of them whose pay is higher.

Procedure for reference to Referral/Recognised Hospitals under CGHS
The beneficiaries will have the option to avail specialised treatment at CGHS recognised hospitals of his/her choice if the specialist of the CGHS dispensary or government hospital recommends the patient for such specialised treatment. After the specialist advises a procedure in writing, the permission letter for taking such treatment in a CGHS recognised private/referral hospital of the choice of the employee in the same city, would be given by the parent department/office. In case the beneficiary, inspite of the facility being available in the city still chooses to get treatment in another city, permission of the CGHS authorities of the city would have to be obtained. In such cases, no TA/DA will be paid by the government. The government servant is allowed to take treatment from referral/recognised hospitals under CGHS in emergency. However, the term 'emergency' will be decided by the Additional Director, CGHS concerned whether the case is/was of real 'Emergency' before reimbursement is made by the parent department on the basis of rates fixed by the CGHS from time to time. Ex post facto permission for treatment in government referral hospitals like PGI Chandigarh etc. can be given by the parent department.
Medical Advance - The medical advance to the serving government servant for self treatment or treatment of the dependents on receipt of estimate from the treating doctor of a government/recognised hospital is available subject to the following conditions:

i) Rs.10,000/- or the amount recommended by the doctor, whichever is less for indoor treatment in hospital and for OPD treatment in case of TB/Cancer.

ii) In case of major illness like by-pass urgery, kidney transplant etc., the advance may be limited to 90% of the package deal wherever it exists or the amount demanded by the hospital concerned.

iii) The advance is paid directly to the hospital concerned on receipt of an estimate.

iv) For settlement of advance, the employee concerned may be required to submit the adjustment bills within a period of one month from the date of his discharge from the hospital. In case the entire advance has not been utilised for the treatment of the patient, the head of office concerned will correspond with the hospital for refund of the unutilised balance of medical advance.

Settlement of Claim -

The government servant is required to prefer claim/bill within 3 months, from the date of discharge from the hospital. If the claim gets time barred, relaxation of delay is allowed by the department depending on the circumstances of delay. The claim should have the following documents completed:

a) Claim Form Med. '97' and Essentiality Certificate ‘A’ for Outdoor treatment and 'B' for Indoor treatment.
b) All original bills verified by the treating doctor with his stamp.
c) Photocopy of CGHS Token Card.
d) Discharge Summary of the Hospital in case of Indoor Treatment.
e) A detailed list of all medicines, laboratory tests, investigations, number of doctors visits etc.
f) Self explanatory letter from the beneficiary and referrel letter fromAMA doctor should be submitted in case of emergency.
g) Legal heir certificate in case of death of the card holder.
Based on the rates fixed by the CGHS, the admissible amount is worked out by the department. If the rates claimed by the concerned are less than the rates fixed by the government, the actual amount is reimbursed. In case CGHS rates are not available for a particular item, the reimbursement is allowed on the basis of rate list of AIIMS. Incidentally, where AIIMS rates are also not available, the actual amount paid by the patient is reimbursed. Items mentioned in the list of inadmissible items under CS(MA) Rules are not reimbursable. Special Nursing Charges are to be reimbursed as fixed by the Ministry of Health from time to time.

The meeting of the National Executive of the Confederation was held at New Delhi today to
review the preparation for an indefinite strike action scheduled to commence
from 20th January, 2009. The meeting heard the Secretaries of the affiliated
Associations/Federations and Unions as also the secretaries of the Co-ordination
Committees. The Comrades who were deputed to attend the State level
Conventions also made their observations at the meeting. Most of the Speakers expressed
the need for further time to reach out the membership in far flung areas.
The meeting came to the conclusion that more intensive mobilization and campaign
programmes are needed to successfully carry out the strike action with full participation of the membership.
It was therefore decided not to commence the strike action from 20th January, 2009 but defer the same to a future date and carry out an intensified campaign amongst the mass of the employees. All affiliates will advise their State leadership to visit all branches and hold meetings to explain the Charter of Demands, educate and mobilise their employees for the eventual strike action.
Campaign material circulated by the Confederation (CHQ)
(available at its website: confederationhq.blogspot.com)
will be translated into vernacular and circulate amongst the members. The said campaign should be concluded by 15.02.2009. The National Executive will meet again in February to take further decision in the matter.

The representatives of the Confederation were to meet the Hon'ble Prime Minister today in a delegation with Com.Basudeb Acharya, MP to seek his intervention in bringing about a settlement of the Charter of Demands . This meeting could not take place due to the preoccupation of the Hon'ble Prime Minister. The meeting is likely to take place on 22nd January, 2009.

The copy of the letter addressed to the Cabinet Secretary to convey the decision of the National Executive is enclosed.

Subject:- Setting up of Anomaly Committee to settle the Anomalies arising out of the implentationof the 6th CPC recommendations.

Definition of AnomalyAnomaly will inculde the folllwing cases:


(a) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the 6th CPC itself without the Commissionassigning any reason: and

(b) Where the maximum of the revised scale is less than the amount at which one is entitled to be fixed except in those cases where the same is as a result of modified fixation formula adopted by theGovernment and

(c) Where the amount of revised allowance is less than the existing rate.


(2) Composition: There will be 2 levels of Anomaly Committees, National and Departmental, consisting of reprensentativesof the Official Side and the Staff Side of the National Council and the Departmental Council respectively.


(3) The Departmental Anomaly Committee may be chaired by the Additional Secretary (Admn.) or the JointSecretary (Admn.), if there is no post of Additional Secretary (Admn.). Financial Adviser of the Ministry/Departmentshall be one of the Members of the Departmental Anomaly Committee.


(4) The National Anomaly Committee will deal with anomalies common to two or more Departments and inrespect of common categories of employees. The Departmental Anomaly Committee will deal with anomaliespertaining exclusively to the Department concerned and having no repercussions on the employees of anotherMinistry/Department in the opinion of the Financial Adviser. The items already taken up by the Fast Track Committeewill not be considered by the Anomaly Committee.


(5) The Anomaly Committee shall receive anomalies through Secretary, Staff Side of respective Council upto six months from the date of its constitution an it will finally dispose of all the anomalies within a period of one yearfrom the date of its constitution. Any recommendations of the Anomaly Committee to resolve the anomaly shallto the approval of the Govenment.


(6) Cases where there is a dispute about the definition of "anomaly" and those where there is a disagreementthe staff side and the official side on the anomaly will be referred to and "Arbitrator" to be appointed out of apanel of names proposed by the two sides. However, this arbitration will not be a part of the JCM scheme.


(7) The Arbitrator so appointed shall consider the disputed cases arising in the Anomaly Committees at the National as well as Departmental level.


(8) Orders regarding appointment of the Arbitrator and constitution of Anomaly Committee at NationalLevel will be issued separately.


(9) All Ministries/Departments are accordingly requested to take urgent action to set up the Anomaly Committeesfor settlement of anomalies arising out of implementation of the 6th CPC recommendations as stipulated above.

LEAVE TRAVEL CONCESSION - RULES




Types of leave travel concession:-



1. Home Town:-The leave travel concession to hometown shall be admissible irrespective of the distance between the headquarters of the Government servant and his hometown, once in a block of two calendar years, such as 2006-2007, 2008-2009 and so on.



(Hometown" means the town, village or any other place declared as such by the Government servant and accepted by the controlling officer)



2. Any Place in India:-The leave travel concession to any place in India shall be admissible irrespective of the distance of the place of visit from the headquarters of the Government servant, once in a block of four calendar years, such as 2006-2007, 2008-2009 and so on:



(The expression "any place in India" will cover any place within the territory of India whether it is on the mainland, or overseas. If there are any local restrictions on visits to places in border areas, it is the responsibility of the Govt. servant undertaking the visit to fulfil the conditions for visit to the places which are subject to local restrictions.)





Govt. of India’s Decision-Leave Travel Concession



Fresh recruits to Central Government may be are allowed to travel to their home town along with their families on three occasions in a block of four years and to any place in India on the fourth occasion.



This facility shall be available to the Government officers only for the first two blocks of four years applicable after joining the Government for the first time.



The blocks of 4 years shall apply with reference to the initial date of joining the Government even though the employee changes the job within Government subsequently.



The existing blocks will remain the same but the entitlements of the new recruit will be different in the first eight years of service. All other provisions concerning frequency of travel under LTC are retained.




Travel entitlements:-

For the purpose of official tour/transfer or LTC, will be the same but no daily allowance shall be admissible for travel on LTC.



Further, the facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.



Air Journey by Private Airlines will however, continue to be admissible as per Ministry of Finance O.M. No. 19024/1/E-IV/2005 dated the 24th March, 2006

(1) LTC to a newly married husband of a female Government servant.



When a female Govt. servant proceeds to her hometown, availing of Leave Travel Concession and gets married in the hometown, LTC may be allowed also to be husband of the female Govt. servant, for the journey performed by him from the hometown to the headquarters of the female Govt. servant.[OM No. 48/2/65-Ests.(A), dated 2.4.1965]



(2) Change of Hometown:-



The hometown once declared and accepted by the controlling officer shall be treated as final. In exceptional circumstances, the Head of the Department or if the Government servant himself is the Head of the Department, the Administrative Ministry, may authorise a change in such declaration provided that such a change shall not be made more than once during the service of a Government servant.



(3) Carry over of leave travel concession.-



A Government servant who is unable to avail of the leave travel concession within a particular block of two years or four years may avail of the same within the first year of the next block of two years or four years. If a Government servant is entitled to leave travel concession to home town, he can carry forward the leave travel concession to any place in India for a block of four years only if he has carried forward the leave travel concession to home town in respect of the second block of two years within the block of four years.



(4) Advance may be granted up to 90% of the estimated Fare.



The President has been pleased to decide that employees of the Lakshadweep and A&N Administrations may be sanctioned an advance of 90% of the estimated ship fare fromIsland to Mainland and back for availing Annual Free Sea Passage. It has also been decided to increase the amount of advance for availing LTC from 80% to 90% of estimated fare in respect of the Central Govt. employees.



(5) Encashment of earned leave along with LTC Leave Travel Concession


(a) Government officers are allowed to encash ten days earned leave at the time of availing of LTC to the extent of sixty days during the entire career.

(b) The leave encashed at the time of LTC will not be deducted from the maximum amount of earned leave encashable at the time of retirement.

(c) It is further clarified that where both husband and wife are Government servants, the present entitlement for availing LTC shall remain unchanged, and encashment of leave equal to 10 days at the time of availing of LTC will continue to be available to both, subject to a maximum of sixty days each during the career.

(d) At least equal number of days of earned leave should be availed along with encashment

(e) The balance at credit should more than 30 days after deducting the total of leave

availed plus leave for which encahment was availed.



The highlights for LTC Leave Travel Concession are:



Leave Travelling Concession (L T C) - Rules at a glance


1.Leave Travelling Concession is admissible to all Government Servants between Headquarters and their Hometowns.


2.Who have completed one year of service on the date of journey, they only eligible to take Leave TravellingConcession.(From 1.9.2008 onwards fresh rcruits along with their families are allowed to visit their home towns on three occasiions and to "Any place in India" on fourth occasion during a block of four years in the initial period of 8 years after joining the government for the first time.)


3.In the case of journey to home town, admisible once in a block of two years. The blocks are 1956 - 57, 1958 - 59 and so on: presently the blocks are 2006 - 07 and 2008 - 09.


4.In the case of journey to "Any place in Indai", admissible once in a block of four years. This will be in lieu of one journey to home town. The current block ia 2006 - 09.


5. Not admissible during holidays alone.(Admissible during regular/casual/special casual leave, study leave, maternity leave and duringpaternity leave.)


6.Also admissible during leave preparatory to retirements, provided the return journey is completed before the expiry of the leave.


7. Leave Travelling Concession is admissible to all journeys by Train/Road/Steamer.


8. In the case of an employee under suspension, admissible only to the family of the government servant.


9. Concession is admissible for self and family.


10. Leave Travelling Concession not availed during a block year, that may be availed within the grace time (i.e., before end of the next year.)


11. Family members may travel independently in any number of batches. The return of each group must becompleted within six months from the commencement of that group's outward journey. This conditionmay be relaxed by the Head of the Department in special cases.


12. The government servant and or members of the familymay travel under the concession to travel to "any where in India"either to the same place or different places of their choice.


13. The government servant can visit his home town also under the concession to travel to "any where in India".


14. Some members of the family can avail home town concession and others can avail "any where in India" concession in the same block year.


15. Reimbursement allowed by the entitled class or actually travelled class, whichever is less.


16. Before commencement of Leave Travelling Concession would be intimated within 45 days, only eligible to get 90% anticipated reimbursement may be granted as advance.

Raising the eligibility limit of PB-2 for Joint Consultative Machinery

OFFICE MEMORANDUM

Subject:- Scheme for Joint Consultative Machinery and Compulsory Arbitration for Central Government Employees - Raising the limit of Pay from Rs. 8900 to Grade Pay of Rs. 4200 in Pay Band -2 for eligibility.

Ministries/ Departments are aware that the Scheme of Joint Consultative Machinery and Compulsory Arbitration for Central Government Employees covers all regular civil employees of the Central Government, except inter-alia persons in industrial establishments, employed mainly in managerial or administrative capacity, and others employed in Supervisory capacity and drawing salary in scales going beyond Rs. 8900 per mensem (vide Clause 1 of the JCM Scheme).

2. With the revision of scales of pay, on the recommendations of the Sixth Central Pay Commission the limit of Rs. 8900 referred to in para 1 above, requires to be suitably revised. The matter has been examined in consultation with Department of Expenditure. It has been dicided that the existing pay limit of Rs. 8900 would correspond to Grade Pay of Rs.4200 in Pay Band -2 revised on the basis of the recommendations of 6th CPC.
Therefore, the Scheme is amended to this extent and Clause 1 (c) of the JCM Scheme may now be read as under,

"Persons in Industrial establishments employed mainly in managerial or administrative capacity, and those who being employed in supervisory capacity draw salary in scaled going beyond Grade Pay of Rs. 4200 in Pay Band-2".


3. This may be brought to the notice of all concerned.

Subject: Decision of the Government on the recommendations of the Sixth Central Pay Commission relating to re-classification of cities/towns for grant of House Rent Allowance (HRA)





The undersigned i directed to refer to this Ministry's O.M. of even number dated 29.08.209 on the above mentioned subject and to state that the cities/tows to which the protection of retaining their higher classification was provided vide this Ministry's O.M. No.2(21)/E.II(B)/2004 dated 16.03.2005 (though placed in lower classification under revised classification) for grant of HRA/CCA, shall continue to retain their higher status/classification, corresponding/equating to further orders and the Central Government Employees working therein will be entitied to draw the rates of HRA accordingly




These orders shall be effective from 1st September 2008




All other conditions governing grant of HRA under existing orders shall continue to apply




In so far as the persons serving in the Indian Audit and Accounts Department are concerned these orders issue in consultation with the Comptroller & Auditor General of India.

a. What are the retirement benefits to KVS employees who are covered under
Pension Scheme ?

An employee of KVS who joined service 1.1.1986 and opted for Pension Scheme or an employee who joined services after 1.1.1986 and before 1.1.2004 is entitled to the following benefits on his/her retirement from Service :-

d.Whether DCRG & Commutation of pension can be released if disciplinary case is

contemplated or pending against the employee at the time of retirement?

In case Departmental proceedings under Rules 14 of CCS (CCA) Rules is pending

against an employee only Provisional Pension is payable.. No other benefits such as

DCRG & Commutation of Pension will be sanctioned until the completion of
disciplinary proceedings.

Expected DA (Dearness Allowance) from Jan 2009 for Central Government Employees



All India Consumer Price Index Numbers for Industrial Workers


All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of November, 2008 remained stationary at 148 (one hundred and fortyeight).


During November, 2008, the index recorded maximum increase of 5 points each in Quilon and Madurai centres, 3 points each in Mysore, Ernakulam, Bhilwara and Coonoor centres, 2 points in 13 centres and 1 point in 14 centres. The index decreased by 1 point in 19 centres and 2 points each in Jalandhar, Nasik, Bhavnagar, Siliguri, Asansol and Howrah centres, while in remaining 20 centres the index remained stationary.


The maximum increase of 5 points in Quilon centre is mainly due to Fish Fresh, Vegetable Items and Washing Soap etc., while that in Madurai centre is mainly due to Rice and Vegetable Items. The increase of 3 points each in Mysore, Ernakulam, Bhilwara and Coonoor centres is due to Rice, Onion, Fish Fresh, Vegetable Items, Tea Readymade, Toilet Soap etc. While the decrease of 2 points each in Jalandhar, Nasik, Bhavnagar, Siliguri, Asansol and Howrah centres is due to decrease in the prices of Vegetable items, Mustard Oil, Groundnut Oil etc.


The indices in respect of the six main centres are as follows :

1. Ahmedabad - 144

2. Delhi - 144

3. Bangalore - 160

4. Kolkata - 147

5. Chennai - 144

6. Mumbai - 151



The point to point rate of inflation for the month of November, 2008 remained constant 10.45% at the level of October, 2008.

The CPI-IW for December, 2008 will be released on the last working day of the next month, i.e. 30th January, 2009.
